　　不同公司、企業簽訂不同的合同的流程也不一樣，下面以勞動合同簽訂流程為例，舉例合同簽訂流程

　　勞動合同簽訂分為兩種情況，一種是新員工入職，另一種是到期續簽。

　　一、新員工簽訂合同。

　　新員工入職當天，人事部人事專員確認新員工名單。準備好合同后，并在其完成入職手續后簽署勞動合同。

　　二、合同到期續簽的。

　　1.人事部在合同到期前一段時間(按公司規定)統計到期人員名單，并向有關部門發出《勞動合同續簽意向反饋表》。

　　2.部門主管收到通知后，填寫《勞動合同續簽意向反饋表》，確認續簽名單，將信息反饋給人事部。

　　3.不同意進行續簽的。

　　1)對于不同意進行續簽的，填寫《員工離職申請表》和合同終止的相關材料，給人事部門審批。2)人事部收到不續簽人員的《員工離職申請表》后進行審批。3)審批不通過，人事部將信息反饋回去，并由部門領導與員工進行協商安排;審批通過的，人事專員將信息反饋給用人部門，按公司要求簽署《終止勞動合同通知書》4)用人部門提交《終止勞動合同通知書》。

　　4.同意續簽的。

　　1)《員工勞動合同續簽意向書》，向人事部反饋。

　　2)員工在規定時間內確認是否續簽，將《員工勞動合同續簽意向書》反饋到部門主管，確認續簽的，人事部在合同到期前一段時間向確認續簽員工發放勞動合同，并在規定時間內收回。

　　合同簽訂要注意以下幾點：

　　1)合同文本的起草。

　　一般，當雙方達成一致協議后，就可以進行合同文本的起草了。通常，起草合同文本的一方掌握主動權。因為起草合同文本的一方，可以按照自己的意思理解文本，而另一方則全然沒有準備，即使仔細審閱了，也可能由于語言上理解的差異而難以發現不利于己方之處。因此，在簽訂合同時，最好能爭取到起草一方，如若不然則一定要謹慎閱讀文本，要求對方進行詳細解釋。

　　2)明確雙方簽約資格。

　　合同時具有法律效力的文件，因此在簽訂合同時雙方一定要具有簽訂資格。在簽訂合同時應及時調查清楚對方的信資情況或者其他情況，也可以要求對方出示相關證明。一般來講，商業上的談判簽約人應該是董事長或者總經理，若是委托，則要求出示有效證明。

　　3)合同要明確規定雙方的義務和責任。

　　這是合同簽訂中至關重要的一環。不能只關注簽訂的條款而忽視義務和責任，特別是當違約情況發生時的責任。這些對應的條款也不能太過籠統，越細致越好。

　　4)合同條款要詳細具體。

　　合同條款籠統不利于合同的履行。合同條款不能重復和矛盾。經常有因為合同內容不具體、明晰而產生法律糾紛的案例。因此合同條款的說明一定要準確、語言文字不能有歧義。

  　　合同簽訂有以下規范和技巧：  

  　　1)合同當事人的姓名。如果是法人的話需要法人名稱。委托方要出示委托證明。  

  　　2)合同標的。如果是買賣合同的話，要注明貨物名稱、規格、型號、購買數量等;如果提供勞務，需要說明勞務的類型、標準。  

  　　3)價格。需要注意貨幣單位。  

  　　4)履行期限。履行期限是合同中不可忽視的關鍵點，超過期限會導致違約。  

  　　5)違約責任。此點需要在合同中標注說明，當當事人違背合同時，可以按照合同規定進行處理。  

  　　6)糾紛解決方式。約定是采用仲裁還是訴訟，這在合同中也十分重要。  

  　　7)法律適用。在國際買賣中，訴訟發生時向哪里的法院進行起訴也是十分重要的。一般以合同簽訂的地點為準。
